If a canned tomato product is moldy at the top, is it safe to remove the moldy portion and use the rest?

There is no way for the consumer to know whether that particular mold is dangerous or not. Molds can produce toxic substances.  The most dangerous of them can cause liver cancer. Therefore, throw the can out. Note that mold can grow on a product even when it's refrigerated.
